Welcome to the Outsole website (now called “Outsole”). We place great value on our service to you as a sneaker enthusiast. To be sure that your expectations match what we offer, we ask you to read the general terms and conditions of Outsole carefully. These terms and conditions apply to every transaction through or derived from Outsole (hereafter referred to as the “Agreement”). When you use Outsole this means that you accept the terms and conditions and are bound by this Agreement. If you do not agree with these terms and conditions, please do not use Outsole.

Article 1 – Changes

We reserve the right to update and change this Agreement at any time without prior notice. That is why we think it is important that you re-read the Agreement every time you use Outsole. When we implement changes to this policy, they will be announced here.

Article 2 – Transactions

When you place an order with us, keep in mind that you are obliged to make the payment. We reserve the right to refuse orders from you. We may, if we deem it necessary, refuse or limit quantities of ordered items, per person, per household, per organization, per country or per order. These restrictions can also apply to future orders from the same account, the same credit card and/or the same billing and/or shipping address. We also reserve the right to refuse or limit orders from, in our view, unauthorized sellers or distributors. If we believe it is necessary to refuse an order, you will be contacted early via your email address that you have released when placing the order.

Article 3 – Items

All items offered by us on Outsole are sold in their entirety and in good faith. The sneakers offered by us are guaranteed to be authentic and will be sent in original packaging, unless explicitly stated otherwise. The prices shown include VAT in accordance with the margin scheme, excluding shipping costs and any transaction costs. Our VAT is in accordance with the margin scheme for collector’s articles and second-hand goods, unless explicitly stated otherwise. Images and descriptions are available for each product; what you see is what you get. Please note that for pictures sneakers may be filled with paper or a shoe tree, which means that the shape of the item may differ from the pictures. Besides, a flash light and extra lightning may be used, which means that the colors could turn out differently at pictures than they are in reality. All sneakers are collector’s items and initially intended for display; not to wear. We explicitly do not guarantee the wearability of sneakers. Wearing items is at your own risk. If you have questions about the condition of a specific item, please contact us.

Article 4 – Availability

All items on Outsole are offered while supplies last. When an ordered item is temporarily or permanently out of stock, we will inform you as soon as possible and you can still decide to cancel or change part of or your entire order. Outsole cannot be held liable for damage that could arise from the temporary / definitive non-availability of an item.

Article 5 – Payment methods

We accept three payment methods in general: (1) Bank transaction / SOFORT. You transfer the total amount of your order directly to our bank account. After placing your order, we can request a screenshot or photo as proof of the transaction. Your order will be shipped as soon as we have received the full payment in our account. (2) iDEAL / Bancontact / GiroPay: Pay directly from your bank account. (3) PayPal: Pay directly or through your credit card from your PayPal account. Outsole charges 4% of the total amount of your order for this payment method to cover the PayPal costs. If your PayPal is linked to a credit card, you may have to pay credit card fees. If the amount received by Outsole is insufficient, you will be requested by e-mail to transfer the remaining amount.

Article 6 – Transport

Your order will be shipped or ready for pick up after we have received the full payment. Make sure your address is entered correctly when placing your order. We are not responsible for orders that cannot be delivered by an incorrect address. If you choose for not using a track & trace code, we can not follow up your delivery and take responsibility of delivery. That also means that we can’t deliver support on delayed envelopes. Of course, we make sure your order arrives. To avoid scams: there are no refund possibilities on envelopes that have not arrived in time of reasonableness and fairness. Please accept that shipments may be considerably delayed because of COVID circumstances. If your envelope has not arrived within 20 business days, please contact us to start up an investigation with delivery services for further actions. Of course, we pack and ship your order as safely as possible. If your package is shipped with a tracking code, you will automatically receive this by e-mail. We have no influence on the displayed tracking information from PostNL. Please contact us if your parcel doesn’t arrive in 48 hours after a delivered status. If you want a delivery service other than PostNL, such as DHL or UPS, then the risks of this delivery service are for your account. For sneakers: please note that the soles and leather of vintage sneakers can be damaged during shipment.

Article 7 – Import tax

If your order has to be delivered outside the European Union, it is possible that you will have to deal with import regulations and/or taxes that are linked to the country of destination. We are not responsible for any extra direct or indirect costs. We have no insight into possible import regulations and/or taxes. Contact your local tax authorities for more information about customs and taxes.

Article 8 – Delivery

Your order will be shipped the next business day and processed by PostNL. PostNL works together with various partners abroad. You receive orders within the Netherlands on average within 1 to 5 business days. For orders with a destination country outside the Netherlands, an average delivery time of 10 business days applies. Please note, your delivery may be delayed by delivery services. Only when there has been no status update by 20 working days can, we take further action. Unfortunately we have no influence on any delays.

Article 9 – Return

Some items can be returned, some items cannot be returned. The right of withdrawal applies to our laces, keychains, merchandise and maintenance items. This means that you can return these items within 14 days after receiving your purchase. Please note, our perishable sneakers are emphatically  not covered by the right of withdrawal. These sneakers are unique in the described condition and are marked as perishable, so that shelf life and wearability are not guaranteed. For that reason, all sales of sneakers are final, even if, for example, the size turns out differently than expected. No guarantee is given on the condition and being able to wear sneakers. If you want to return items other than sneakers, we ask you to use our Return form. After we have received your items back, we will transfer the amount paid by you within 14 days to the account where payment was made. To be sure that we actually receive your items back, we recommend using a tracking code at all times. The shipping costs of returning are for your own account. Click here for our return form.

Article 10 – Conditions
It is important that you have a correct understanding of the condition of our sneakers. These sneakers are unique in their condition and are marked as perishable. All sneakers are second-hand and will contain traces of use, even if they are in new condition. We therefore guarantee wearability of sneakers in no case. We recommend to use sneakers for display. There may be tiny cracks in the sole or the glue may have dried out. There may also be hidden traces of use in a shoe that have been repaired in the past. We are not responsible for this. Please keep in mind that the original item packaging also has traces of use. As far as possible for us, the condition of items is shown on the item’s pictures and in the related descriptions. If we can tell in advance that a sneaker is absolutely not wearable, this will be explicitly communicated. Unfortunately, we cannot always predict this. If you are in doubt about the condition of a sneaker, please contact us. It is therefore not possible to discuss the conditions of items afterwards.

Article 11 – Privacy

You can visit Outsole without having to provide personal information. When you use our forms or place an order, we do need personal information from you. We treat this information as strictly private and confidential and it will not be sold or shared with other parties. An exception to this is when we believe in good faith that disclosure of such information is necessary to comply with applicable laws, regulations, legal proceedings or an enforceable request from the government. We only use data that you provide to make your order process as fast and easy as possible.

Article 12 – Liability
