Terms & Conditions

Welcome to the Outsole web site, which include but is not limited to www.outsole.nl (the “Sites”). The Sites are provided as a service to our customers. Please review the following terms and conditions of use, which govern your use of the Sites (the “Agreement”). Your use of the Sites constitutes your agreement to follow and be bound by the Agreement. Outsole reserves the right to update or modify this Agreement at any time without prior notice. For this reason, we encourage you to review the Agreement whenever you use any of the Sites. If you do not agree to these terms, please do not use the Sites. The relationship of us with you as loyal customer is highly valued. It therefore is of utmost importance that your rights are respected and that you have confidence in Outsole.

Article 1 – Changes 

We reserve the right to modify the Terms & Conditions and this privacy statement at any time, so please review it frequently. If we make material changes to this policy, we will notify you here.

Article 2 – Site Transactions

If you proceed to place an order with us, please notice that each order you place is with payment obligation. We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, per business, per country or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event we make a change to or cancel an order, we will attempt to notify you by contacting the email and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by unauthorized re-sellers or distributors.

Article 3 – Items

All items we sell are 100% authentic and are shipped in original packaging unless stated otherwise. The prices shown include VAT (21%) and exclude shipping costs or any other related fees (for example PayPal fees). Our VAT is in accordance with the margin scheme related to collector’s items and second hand goods. The images and descriptions of items are clearly displayed, what you see is what you get. However, if you would like to place an order, please accept that all items are second hand and might show signs of wear. Please be aware of that we may have used some kind of shoe tree or other forms of stuffing when taking pictures, whereby the actual shape of items can differ from the pictures. Besides, we may have used flash light when taking pictures, whereby the actual color of items may differ from the pictures. Also, the light of the first picture of the picture gallery of a single item might be edited in Lightroom. All items are collectibles and initially intended to display; not to wear. Wearability can not be guaranteed by us, and wearing items is at your own risk. If you still have any questions about the condition of a certain item, please contact us.

Article 4 – Availability

All the products at the Sites are offered until stocks are exhausted. If a product is temporarily or permanently out of stock, we will inform you as soon as possible and you can still decide to change a part of, or cancel your entire order. Outsole cannot be held liable for damage that may result from the temporary or permanent unavailability of an item.

Article 5 – Payment Methods

We do accept three payment methods: (1) Direct bank transfer (IBAN): We accept payments through a bank transfer. This payment method is free. You are required to realize the bank transfer within 24 hours to reserve the item(s). We will contact you to send us a screenshot or picture of the bank transfer to prove that the transaction has been made. Please notice that it may take 1 to 5 business days before the funds have cleared into our account; (2) iDEAL: Dutch customers are able to pay through iDEAL, by which you are able to pay through your Dutch bank account. This payment method is free; (3) PayPal: We charge an extra 4% to cover your related PayPal fees. If your PayPal is linked to a credit card, you must add credit card fees to the total amount. This does not apply to payments through your PayPal balance or a linked bank account. We do only accept payment in euros. If payments are transferred in another currency, and PayPal charges currency conversion fees, we will contact and require you to pay this amount to us. Your order won’t be shipped until the funds have cleared in our account.

Article 6 – Transport

Items will be shipped after receiving your full payment. The risk during transport of the ordered items is on your behalf. You understand and agree that Outsole can not be held liable for any direct or indirect damages done by any of the services we provide. All items are purchases at your own risk. Any damage caused from shipping is to be taken up by you with the shipping company. We do not assume any responsibility for lost packages. ‘Sneakers’ or large amount of ‘Laces’ will be shipped insured (to €500) with a track and trace code to foreign countries. Packages within the Netherlands will be shipped ‘Standaard’. Please make sure that you enter your address and telephone number correctly, and to make sure that someone is at home when your package is scheduled for delivery. Orders may be returned to the Netherlands after two failed delivery attempts. This process may delay your delivery for a couple of weeks and we will require you to pay shipping costs for the second time. Orders including a single set or a few sets of laces may be shipped without a track and trace code, to save you on shipping costs. Outsole will provide you the track and trace code and contact information of the delivery service as needed. Once this information is provided to you, it is your responsibility as the customer to contact and deal with the delivery service. We do not take any responsibility of the displayed track and trace information by PostNL.

Article 7 – Import Tax

When ordering items from Outsole for international deliveries, you may be subject to import duties and/or taxes that apply to your country. We are not responsible for any charges that are incurred from customs/duties whatsoever. Any additional charges for customs clearance are considered outside of our control, and we cannot predict the value of what these charges may be. For further information on custom and excise policies in your country, please contact your local customs office.

Article 8 – Delivery Time

With regards to ‘Sneakers’: After we have received your payment, the estimated delivery period of orders within the Netherlands is 5 working days. The estimated delivery period of orders outside the Netherlands is 10 working days, but may vary depending on the destination. With regards to orders including only ‘Laces’: the estimated delivery period of orders within the Netherlands is 5 working days. The estimated delivery period of orders outside the Netherlands is 20 working days, but may vary depending on the destination. Outsole is not responsible for any delays of your package during delivery, and we have no control over the delivery time. By placing an order with us, you accept the risk that your package may be delayed during shipment.

Article 9 – Return 

All our second hand items are unique for you as customer and are seen as perishable; for that reason are all sales final. This means that it’s not possible to return purchased items. Outsole never refunds any related shipping costs. All our items are collectibles, intended for display, unique, and perishable, whereby wearability cannot be guaranteed. We do not offer you time for reflection; the E-Commerce law and in particular the 14 working days period for reflection, does not hold good for items purchased at Outsole. By placing your order you accept the fact that you forgo time for reflection. There are no exceptions on this Article. Items usually contain signs of wear and may not be wearable. There may be tiny cracks in mid soles and these may appear during the shipping process. It is also possible that there are hidden flaws, repaired in the past. Outsole is not responsible for these flaws. Please be aware of that used items and its packaging are generally not flawless. The actual condition of the item(s) is clearly described and displayed at the images. As far as possible, the actual condition of an item is displayed at the images and the related description. You are deemed to interpret the condition correctly based on this information. It is not possible to discuss the condition of sold items afterwards.

Article 10 – Privacy

We respects our customer’s account information as private and confidential information, and will not share it with any outside organizations or individuals unless we have a good faith belief that disclosure of such information is necessary to satisfy any applicable law, regulation, legal process or enforceable governmental request.

According to the General Data Protection Regulation (GDPR) Outsole is responsible for processing personal data as elaborated in this privacy statement.

Article 11 – Liability

Outsole is only liable if there is clear negligence and carelessness in handling of our clients. While compiling the contents of this online store the utmost care has been made, Outsole any liability for inaccuracies, omissions or any consequences of action the basis of information provided on or through this site is available.
